Using TV audio for Radio Doc

Hi guys

I'm producing a documentary for radio and want to use some audio from ITV's Xfactor.
I was wondering if anyone had any experience of how you apply to use audio?

I know there's "fair use" that can be used, but feel in this occasion I probably need to apply for permission.

The doc is about ADHD and features a past contestant who was diagnosed with it. I literally just want to use 5 second of him singing on the show with the Peter's voice introducing him.

Any help would be very much appreciated.

presumably this is for community radio, as if it was for commercial radio then this is something they would've covered with everyone when starting to work for them.

If I presume right, I'd just go ahead. It's fair use as you're using it for the purposes of discussion. It's not like you're using it for any nefarious purpose.

Syco own the copyright. Ask for permission to use the audio. If you use it without consent, you could face legal proceedings. The same applies to any copyright, no matter what the intended use is.
This is just using common sense surely?

Look up 'fair use', David. The rules have changed and this would be allowed. It's about the only good thing the Tories have done.

Yeah, for its community radio.
The station is part of a Uni and our lectures are also suggesting entering it for awards and possibly if it's a high enough standard, onto other stations such as BBC 3 / 4.

I just wasn't sure where I needed to go, contact wise.
